Manufacturers, before they introduce an appliance into the market, have to get a compatibilty assessment. This will assure that the appliance has been produced according to the requirements. The manufacturer will also have to keep technical documentation containing all its creation phases: from its project, through production, till a ready-made product. The documentation is necessary, because upon its basis, the assessment will be made. The appliance cannot cause electromagnetic disorder and it should also resist such disorder. Appliances, allowed to go on sale, will have to get a compatibility assessment and EC labelling
Appliances should be equipped with information on a manufacturer, his authorised representative, instruction and maintanance manual, and advice on safety measures and use restrictions. The new provisions do not concern medical, telecommunication and aviation equipment. The Act will not cover the appliances used by uniform and special service. It is President of the Office of Electronic Communications who will supervise the observance of the Act. The new provisions will adjust the Polish Law to the EU Law, ie Directive 2004/108/EC of the European Parliament and of the Council of 15 December 2004 concerning electromagnetic compatibility.
