On 8 April 2010, the Sejm passed an act on the support for development of telecommunications services and networks. The act establishes a legal framework for universal access to telecommunications services, especially broadband access. It includes comprehensive solutions to make it easier for investing in telecommunications and developing competition in the market. The new regulations have been passed to boost up investment potential of local authorities.
The most important regulations are aimed at:
• allowing local authorities to undertake economic activity in telecommunications (its own facultative activity), and specify fundamental rules for local authorities to intervene in the local market without disrupting competition;
• facilitating investment in regional broadband networks (implemented by local authorities and funded from EU);
• abolishing investment barriers in local plans of spatial development;
• introducing an obligation for road operators to place technology channels within the right of way at the construction or conversion of public roads;
• establishing an exclusive property of optical fibres.
