Telecoms package adopted

5 November 2009, Members of the European Parliament and representatives of the European Council reached an agreement on the telecoms package, and especially - Directive (2002/21/EC), i.e. Framework Directive.

The agreed text clarifies that a user’s internet access may be restricted if it is appropriate, proportionate and necessary within a democratic society. Such measures may be taken only with due respect for the principle of presumption of innocence and the right to privacy and as a result of a prior, fair and impartial procedure guaranteeing the right to be heard and the right to an effective and timely judicial review. In duly substantiated cases of urgency, appropriate procedural arrangements may be made provided they are in line with the European Human Rights Convention and EU law.
The amendment improves consumer rights and cooperation of national regulators, increase standards and reduce prices, and enable the disabled to access the Internet.
The whole package of legislative proposals can now proceed to final votes in the European Parliament later this month and in the Council of Ministers. It is expected by the end of November this year.
