European Commission promotes NGA

On 17 June 2009, within the framework of the Communications Committee meeting, the European Commission presented an amended draft recommendation on high speed Next Generation Access networks (NGA). The European Commission has launched a public consultation on the regulation. The public consultation will be open until 24 July 2009. The Commission plans to adopt the Recommendation, taking account of comments received, before the end of 2009.

The recommendation is mainly to achieve a common regulatory framework for NGA within the Community in order to foster timely investment in very high speed networks while ensuring that the competitive structure of the market is maintained. Especially, it is recommended to overview markets 4 and 5 relating to NGA. It is also advised to deploy consistent regulatory responses to markets 4 and 5. National Regulatory Authorities (NGA) is therefore obliged to provide guidance aimed at preventing any inappropriate divergence of regulatory approaches. It is also recommended that if a dominant operator rolls out NGA networks on so called “greenfield sites”, NGA will not reguire it to roll out parallel traditional copper wire networks. NRA should therefore allow for operators to deploy complementary NGA technologies.

Moeover, the Recommendation has for the first time suggested the definition of Next Generation Access broadband networks.
