1. Railway Department deals with the issues related to:
1) the railway transport act, excluding the issues handled by the Bureau for Crisis Management and Protection of Classified Information;
2) the act on the commercialisation, restructuring and privatisation of PKP;
3) the act on railway transport of dangerous goods;
4) the Railway Fund Act;
5) the public transport act, regarding railway transport, cable transport, cable railway transport (funicular) and other railway transport, i.e. the underground;
6) the transport law, regarding railway transport;
7) the act on land transport infrastructure financing, concerning rail infrastructure;
8) the act on public finance, with regard to rail infrastructure financing.
2. The Department executes the tasks of the minister for transport under the following provisions:
1) the occupational medicine act, regarding work at rail;
2) the technical supervision act, with regard to railway transport;
3) the act on upbringing in sobriety and counteracting alcoholism, concerning the sale, service, and consumption of alkohol on trains;
4) the law on geodesy and cartography, with regard to defining closed areas;
5) the energy law, regarding qualifications for positions responsible for supervision and operation of energy plants and installations applied in railway transport entities;
6) the Labour Code, regarding health and safety at work in railways;
7) the Construction Law, as regards technical conditions to be met by building structures and their location, technical conditions and use of building structures, and authorizations in case of deviations from technical and building provisions in the field of rail infrastructure.
3. The Department conducts administrative proceedings within the competence of the minister for transport under the following provisions:
1) the railway transport act, regarding:
a) deviations from technical conditions for operation of rail vehicles and rail traffic management and signalling,
b) liquidation of a railway line or section of a railway line,
2) the act on the commercialisation, restructuring and privatisation of PKP, regarding administration of fixed assets;
3) the technical supervision act, relating to:
a) permission to manufacture, repair, modernize technical equipment, materials and components used in their manufacture, repair or upgrade,
b) operation of technical equipment,
c) manufacture and marketing of technical equipment as an office of higher degree in the field of railways,
4) the act on principles for recognition of professional qualifications acquired in the EU Member Countries, as an office of a higher degree;
5) the public transport act, as to impose fines on carriers or operators.
4. The Department deals with the issues related to:
1) cooperation with the State Commission for Investigation of Railway Accidents;
2) electronic information exchange systems and intelligent transport systems, regarding railway transport and rail infrastructure;
3) investment in:
a) rail stock and intermodal transport partly related to railways, supported from public funds,
b) rail infrastructure projects supported from public funds,
4) resulting from a Minister’s competence to organize public transport - on communication line or communication network in inter-provincial and international passenger transport by rail;
5) rights and obligations of rail passengers.
5. On behalf of the Minister, the Department supervises:
1) President of the Office for Railway Transport;
2) Railway Institute in Warsaw (formerly Railway Scientific and Technical Centre);
3) Transportation Technical Supervision, regarding railway transport.
6. The Department deals with the matters related PKP S.A. and PKP PLK S.A. on behalf of the minister for transport who represents the State Budget.
