1. The Department of Spatial Development and Construction executes its tasks under the following provisions:
1) the spatial development act;
2) the act on construction products;
3) the construction law;
4) the act on professional asscoiation of architects, civil engineers and urban planners;
5) the act on family allotments, regarding spatial development;
6) the act on special rules for reconstruction, renovation and demolition of buildings destroyed or damaged as a result of natural disaster - within the competence of the minister responsible for construction, spatial development and housing, in the field of spatial development and construction;

2. The Department executes the tasks of the minister for construction, spatial development and housing under the following provisions:
1) the act on cemeteries and interment;
2) the act on maritime areas of the Republic of Poland and marine administration;
3) the act on providing information on the environment and environmental protection, public contribution to environmental protection and on environmental impact assessment;
4) the water law;
5) the act on spatial data infrastructure;
6) the environmental protection law, regarding ecophysiographic studies;
7) the act on supporting the development of telecommunication services and networks;
8) the act on supporting thermomodernisation and repairs, regarding energy performance audit and its verification;
9) the energy performance act;
10) the act on mass events security;
11) the act on public utility explosives;
12) the Public Procurement Law;
13) the Labour Code, regarding health and safety at work on construction sites;
14) the Election Code;
15) the Postal Law.

3. The Department conducts administrative proceedings within the competence of the minister for construction , spatial development and housing under the following provisions:
1) the act on spatial data infrastructure, regarding the refusal to include third-party spatial data into infrastructure of collections and services;
2) the construction law, concerning the loss of rights to draw up energy performance certificates for buildings, housing units or part of a building constituting independent usable and technical areas of the premises.

4. The Department conducts administrative proceedings within the competence of the minister for construction, spatial development and housing under the act on investment in the liquefied natural gas terminal in Świnoujście, as an office of a higher degree, concerning permits of construction and occupancy.

5. The Department deals with the issues related to:
1) compliance of provincial development plans with the national development plan and governmental programmes for public utility investment;
2) cross-border and border cooperation in the field of national spatial development;
3) periodic reports on national spatial development;
4) register of governmental programmes to implement public utility national investments;
5) urban policy;
6) complaints to governor’s provisions on the arrangements of a study on municipal spatial development conditions and directions or local spatial development plan or amendments thereto with respect to compliance with the findings of the relevant government tasks;
7) inclusion of third-party spatial data into infrastructure of collections and services - within the competence of the minister for construction, spatial development and housing;
8) register of decisions on establishing locations of regional broadband;
9) professional society of architects, civil engineers an urban planners;
10) energy performance certificates for buildings, housing units or part of a building constituting independent usable and technical areas of the premises, including the acquisition of powers to issue them;
11) energy performance in construction;
12) authorizations in cases of derogations from building and technical provisions - in terms of technical conditions to be met by buildings and their locations;
13) syllabi of post-graduate studies for thermomodernisation and energy performance appraisals for buildings;
14) appointing a housing natural person or organisational unit by the minister for construction, spatial development and housing to issue opinions attached to construction permits for buildings;
15) minister’s consent to construction of national gas pipes or if the construction results from international agreements;
16) architectural policy.

The Department provides office services to the Urban Architectural Commission.

On behalf of the minister, Department also supervises:
1) General Inspector of Building Control;
2) Institute of Construction Technique in Warsaw;
3) Institute of Spatial Management and Housing in Warsaw;
4) Institute of Urban Development in Cracow.
